RELEASE OF LIABILITY
READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for participation in the activity of RV Plant Tour organized by Grand Design RV, of 50771 SR 13, Middlebury 46540 ("Facility") and/or use of property, facilities and services of Grand Design RV,

agree for myself and (if applicable) for the members of my family, to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions of directions by Grand Design RV, or the employees, representatives or agents of Grand Design RV
2. I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for the personal injury to myself and (if applicable) my family members, and further release and discharge Grand Design RV for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Grand Design RV, whether caused by the fault of myself, my family, Grand Design RV or other third parties
3. I agree to indemnify and defend Grand Design RV against all claims, causes of actions, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Grand Design RV.
4. I agree to pay for all damages to all facilities of Grand Design RV caused by my or my family's negligent, reckless, or willful actions.
5. Any legal or equitable claim that may arise from participation in the above shall be resolved under Indiana law.
6. I recognize and agree that (a) the products manufactured or to be manufactured and sold by Grand Design RV ("Products") are unique, (b) the manufacturing equipment used or to be used by Grand Design RV ("Equipment") is unique, (c) there is proprietary information involved in the manufacturing processes employed by Grand Design RV ("Manufacturer Processes") and (d) the layout of the Facility, all prototypes, the Products, the Equipment, the Manufacturing Processes and information which may be revealed from a tour of the Facility constitutes highly confidential and proprietary information of Grand Design RV. Accordingly, I agree that in consideration of Grand Design RV granting me access to and an opportunity to view and visit the Facility and to receive or obtain information relating to the Facility, Products, Equipment and Manufacturing Processes, I will use that information only for purposes explicitly permitted by Grand Design RV in writing and will not discuss, reveal, disclose, to any third party or otherwise use any information obtained during the visit to the Facility unlesss and until such information becomes a part of the public domain other than by my breach of this agreement. I further agree that I will not take any photographs, make any digital images or make any audio or video recordings while on the premises of the Facility.
7. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Grand Design RV has offered to refund any fees I have paid to use its facilities if I choose not to sign this agreement.
8. This Agreement and each of its terms are the product of an arms' length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.
9. The invalidity of unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other application of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be part of this Agreement.
10. Any controversy or claim rising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administrated by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
